Website and Mobile App Terms and Conditions of Use

MyPark, Corp. (“MyPark”)

Welcome to MyPark. MyPark provides access to its services on the following terms and conditions.  In return for gaining access to the application, you agree to be bound by these terms and conditions of use without limitation or qualification. This document is a legally binding agreement between you as the user(s) of the application (sometimes referred to as “you”, “your” or “User” hereinafter) and MyPark (sometimes referred to as “we”, or “our” hereinafter). If you do not intend to be legally bound by these terms and conditions of use, do not access or use the application.

You acknowledge and agree that MyPark may amend any Terms at any time by posting the relevant amended and restated Terms on the Website or Mobile App. By continuing to use the Services, Mobile App or the Website, you agree that the amended Terms will apply to you. Your use of the Mobile App, Website and MyPark’s services, software and products (collectively, “Services”) is subject to the terms and conditions contained in this document. Please read them carefully.

If you visit the website or use the mobile app, you accept all Terms and Conditions.

1. Terms & Conditions for MyPark’s Parking Service

By opening or using a wireless parking account with MyPark (the “Account”), you agree to be bound by the terms and conditions contained in this agreement, which govern your use of the Account. Please read this agreement carefully and keep it for future reference.

In this agreement, the following terms have the meanings indicated below:

  • “Account” or “account” means all MyPark wireless parking service accounts opened by you on the MyPark Mobile App or UseMyPark.com,
  • “facility operator” means the operator of a parking facility using the MyPark service,
  • “service” means the service offered by MyPark allowing you to pay for parking at participating parking facilities by using your phone pursuant to the terms and conditions of this agreement,
  • “we”, “us”, and “our” mean  My Park Corp., along with our successors, affiliates or assigns,
  • “website” or “site” means the website currently located UseMyPark.com or mobile application as well as any successor to such site or application,
  • “you” and “your” means the person(s) who have established the Account, and
  • “your phone” refers to the cellular or other phone you have enabled to use the Account.

2. Account Information

You may change your Account profile at any time. You agree to provide us with your valid registration information, including, without limitation, your contact information, email address, and payment information. You may not impersonate or misrepresent your identity to us. It is your responsibility to review and revise your Account information so that it is accurate and current at all times. You further agree to comply with all state or local restrictions that may be applicable to your registration with us. We reserve the right to terminate your Account if your Account contains any untruthful information. You are solely responsible for use of your Account and you agree to notify us immediately in the event of an unauthorized use.

3. Using your Account

Purpose: You can use the Account to pay for parking at any parking facility that uses the MyPark service. You will be emailed a receipt for each transaction.

Use of Account, Password, and your Cell Phone: ? To create an account, you will need to provide us with your name, email, and payment information, which may be credit card information or through PayPal. You agree:

You are liable for any transactions made by a person you authorize or permit to use your Account. If you permit someone else to use the Account, we and the facility operator will treat this as if you have authorized this person to use the Account and you will be responsible for any transactions initiated by such person with the Account

4. Pricing, Payment and Refunds

You agree to pay all fees for Services provided to you pursuant to these Terms and Conditions.  MyPark shall process the parking fee and other Services by charging your credit card, debit card, or PayPal account at the time of your parking transaction. You must have a valid credit, or debit card, or PayPal account, or suspension of services may occur. If your credit card or debit card is declined your MyPark account may be blocked or terminated. Additionally, MyPark reserves the right to transfer the claims for unpaid parking fees to third parties.

Charges by MyPark may be changed as described below. ?? The service charge for each spot will be displayed on the application before being reserved.  Each time you use the Account, the amount of the transaction, including applicable taxes and service charges, will be charged to the credit card used to open the Account. We will inform you of the amount to be charged for a particular transaction via email receipt. You authorize MyPark to charge your credit card for such amounts each time the service is used. ??If you have any questions about a refund or other similar issue, please contact info@myparksystems.com.

You agree that the fees and service charges included in the transaction cost confirmed before you start parking apply to the Account and may be charged to the Account. You authorize us to initiate any such charges to the Account as applicable. ??A chargeback fee may be assessed if an attempt to charge your Account is rejected for insufficient funds available on your credit card, for cancellation of your credit card or otherwise.

5. Reservation and Fee Structure

With the Park Now feature you may reserve a spot no more than fifteen (15) minutes prior to arrival. The fee for a parking spot may be a flat fee, by the hour, or another method as determined by MyPark.  A hold will be placed on your credit card upon arrival and you will be charged upon departure.

6. Verification of Transactions

Details of your transactions will be emailed to you only. Transaction history may not be available on the MyPark mobile application or website. It is your responsibility to ensure accurate record keeping of all receipts. You may email info@myparksystems.com for more information about your account.

7. Failure to Complete Transactions

We and the facility operators accept no liability to complete any transaction which cannot be cleared by our payment processor, whether because there are not sufficient funds available on your credit card or otherwise.?? Neither we nor any of the facility operators we have relationships with will be liable to you for any failure to accept or honor the Account.

8. MyPark is NOT a Parking or Transportation Company

MyPark provides a service to enable your payment for parking at certain facilities. MyPark does not own, operate or maintain parking facilities and is NOT RESPONSIBLE FOR ANY SUCH FACILITIES OR EVENTS THAT OCCUR AT SUCH FACILITIES. Parking facilities are operated by companies which MyPark has contractual relationships with, but MyPark is not responsible for actions taken by such companies.

THE COMPANY DOES NOT PROVIDE TRANSPORTATION SERVICES, AND THE COMPANY IS NOT A TRANSPORTATION CARRIER. THE COMPANY DOES NOT AND DOES NOT INTEND TO PROVIDE TRANSPORTATION SERVICES OR ACT IN ANY WAY AS A TRANSPORTATION CARRIER, AND HAS NO RESPONSIBILITY OR LIABILITY FOR ANY TRANSPORTATION SERVICES BY YOU OR PROVIDED TO YOU.

9. Disclaimer of Service Level Guarantees and Warranties

NOTE THAT THIS SERVICE IS ONLY AVAILABLE IN SELECTED LOCATIONS AND MAY NOT BE AVAILABLE AT ALL TIMES AT ACTIVE LOCATIONS. While we will endeavor to provide the best possible service, there are limitations to cellular and payment technologies which may cause interruptions in service. Please note that WE PROVIDE NO SERVICE LEVEL GUARANTEES WHATSOEVER concerning this service.?? Unless the law provides otherwise, you waive and release us from any obligations that could arise due to defenses, rights and claims you have or may have against any third party on account of the use of the Account.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

THE SERVICES SUBJECT TO THIS AGREEMENT ARE PROVIDED ON “AS IS” AND “AS AVAILABLE” BASIS. MYPARK MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THIS SERVICE OR THE INFORMATION, CONTENT, MATERIALS, OR PRODUCTS INCLUDED ON THIS SITE. YOU EXPRESSLY AGREE THAT YOUR USE OF THIS SITE AND OUR SERVICE IS AT YOUR SOLE RISK.?? TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MYPARK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. MYPARK DOES NOT WARRANT THAT ITS WEBSITE, ITS APP, ITS SERVERS, OR E-MAIL OR NOTIFICATIONS SENT FROM MYPARK ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. MYPARK WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF ITS SERVICE, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES.?? MYPARK DOES NOT OWN, CONTROL OR OPERATE PARKING FACILITIES. ACCORDINGLY, MYPARK DOES NOT WARRANT ANYTHING WITH RESPECT TO SUCH FACILITIES. MYPARK WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM OR RELATED TO ANY PARKING FACILITY OR ITS OPERATION, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES. ??CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.

10. Refunds

We will make every attempt to deliver a high level of service at all times. If you think there has been a billing or accounting error, please contact info@myparksystems.com. If you are entitled to a refund for any reason for services obtained with the Account, you agree to accept credits to the credit card        or Paypal account used to open the Account in place of cash. We and the parking operators will not provide cash refunds.

11. Loss, Theft or Unauthorized Use

You are responsible for all authorized uses of your Account. Applicable law may protect you from liability for unauthorized purchases. You understand that your Account is not a credit account and is not protected by laws covering credit accounts.

Tell us AT ONCE if you believe that your Account has been used by an unauthorized person. Contacting us is the best way to KEEP YOUR POSSIBLE LOSSES DOWN. IF YOU BELIEVE THAT YOUR PHONE HAS BEEN STOLEN, OR THAT SOMEONE HAS TRANSFERRED OR MAY IMPROPERLY CHARGE THE ACCOUNT WITHOUT YOUR PERMISSION, CONTACT INFO@MYPARKSYSTEMS.COM. IF YOU FAIL TO NOTIFY US PROMPTLY OR YOU ARE GROSSLY NEGLIGENT OR FRAUDULENT IN THE HANDLING OF THE ACCOUNT, YOU COULD INCUR ADDITIONAL CHARGES. ??If your phone or credit card has been reported lost or stolen, we may close the Account to keep your and our losses down.

12. Notice Containing Information About Your Right to Dispute Errors

In case of errors or questions about electronic transactions on the Account, email us at info@myparksystems.com, including if you think the statement or receipt is wrong or if you need more information about a transaction listed on the statement or receipt.?For disputes that we (rather than a facility operator) are involved in, we must receive the email from you no later than 10 days after the transaction in question. (Disputes involving operators of parking facilities will be resolved pursuant to their procedures.)

The following information must be contained in that notice:

  • Your name, user name and phone number or numbers used for the Account.
  • Description of the error or the transaction you are unsure about and explanation as clearly as possible of why you believe it is an error or why you need more information.
  • The amount of the suspected error.

Generally, we will tell you the results of our investigation within 30 business days after we hear from you and will correct any error promptly. If we need more time, however, we may take up to 45 business days to investigate your complaint or question If we decide there was no error, we will send you a written explanation within three business days, after we finish our investigation. You may ask for copies of documents that we used in our investigation.

13. Dispute Resolution and Confidential Arbitration

Any dispute relating in any way to the services offered by MyPark not resolved in accordance with the preceding Section 12 shall be submitted to confidential binding arbitration in Miami-Dade County, Florida, except that, to the extent you have in any manner violated or threatened to violate MyPark’s intellectual property rights, MyPark may seek injunctive or other appropriate relief in any federal court in the State of Florida, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association conducted by a single arbitrator. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. You agree that Florida will be the governing choice of law for all disputes. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

14. Disclosure of Account Information to Third Parties

From time to time, subject to any applicable financial privacy laws or other laws or regulations, we may provide information about you and the Account:

  • To parking companies or facilities we have relationships with.
  • In response to any subpoena, summons, court or administrative order, or other legal process which we believe requires our compliance.
  • In connection with collection of indebtedness or to report losses incurred by us.
  • In compliance with any agreement between us and a professional, regulatory or disciplinary body.
  • In connection with potential sales of business to parking companies and others.
  • To carefully selected service providers and merchant partners who help us meet your needs by providing or offering our services (“Network of Merchant and Service Providers”).

You may tell us that you prefer that we not share this information with our Network of Merchant and Service Providers by sending your request to info@myparksystems.com including your name, address, phone number and mobile user name.

15. Use of Cell Phones While Driving Can be Dangerous

PLEASE NOTE THAT OPERATING A CELL PHONE OR ANY OTHER DEVICE WHILE DRIVING CAN BE DANGEROUS AND WE ADVISE YOU USE THE VOICE COMMAND OPTION ON THE MOBILE APP WHILE OPERATING A VEHICLE. YOU AGREE TO INDEMNIFY AND HOLD MYPARK HARMLESS FROM ANY OR ALL LIABILITY WHATSOEVER FOR ANY HARM, LOSS OR INJURY RELATED TO USE OF THIS SERVICE OR THE ACCOUNT WHILE OPERATING ANY KIND OF VEHICLE.

16. Licenses and Site/App Access

General Licenses: Solely for use in connection with the service, MyPark grants you a limited license to access and make personal use of its web site, its Mobile App, and its Service. This license does not include any resale or commercial use of MyPark’s service; any collection and use of any information, descriptions, or prices; any derivative use of this site or its contents; any downloading or copying of account information for the benefit of others; or any use of data mining, robots, or similar data gathering and extraction tools. All materials and information related to MyPark may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without the express written consent of MyPark. Any unauthorized use terminates the permission or license granted by MyPark. You may not use any MyPark’s logo or other proprietary graphic or trademark without MyPark’s express written permission.

You will not use, copy, adapt, modify, prepare derivative works based upon, distribute, license, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast or otherwise exploit the Service, Application or content, except as expressly permitted in this Agreement. No licenses or rights are granted to you by implication or otherwise under any intellectual property rights owned or controlled by Company or its licensors, except for the licenses and rights expressly granted in this Agreement.

Application License: Subject to your compliance with this Agreement, MyPark grants you a limited non-exclusive, non-transferable license to download and install a copy of the Application on a mobile device or computer that you own or control and to run such copy of the Application solely for your own personal use. Furthermore, with respect to any Application accessed through or downloaded from the Apple App Store (“App Store Sourced Application”), you will use the App Store Sourced Application only: (i) on an Apple-branded product that runs iOS (Apple’s proprietary operating system software); and (ii) as permitted by the “Usage Rules” set forth in the Apple App Store Terms of Service. Company reserves all rights in and to the Application not expressly granted to you under this Agreement.

17. Amendment and Cancellation

We may at any time change or repeal these terms and conditions. You will be notified of any change in the manner provided by applicable law prior to the effective date of the change. You specifically agree to accept such notice of change by notice sent to the last electronic mail address you have provided to us. However, if the change is made for security purposes, we can implement such change without prior notice. Should you decide that you no longer agree to accept changes or notices electronically, we may cancel or suspend this agreement or any features or services of the Account described herein at any time. The Account remains our property.

We may cancel your right to use the Account at any time. You may cancel this agreement by closing your Account on our web site or by emailing us at info@myparksystems.com. Your termination of this agreement will not affect any of our rights or your obligations arising under this agreement prior to termination.

18. Applicable Law

By opening the Account, you agree that the laws of the State of Florida without regard to principles of conflict of laws, will govern these Terms and Conditions and any dispute of any sort that might arise between you and MyPark or its affiliates, as well as any of their successors and assigns.

19. Trademarks and Copyrights

MyPark and other marks indicated on our site are registered trademarks of MyPark, Corp. or its subsidiaries in the United States and other countries. Other MyPark graphics, logos, page headers, button icons, scripts, and service names are trademarks or trade dress of MyPark, Corp. or its subsidiaries. MyPark’s trademarks and trade dress may not be used in connection with any product or service that is not MyPark’s, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits MyPark. Furthermore, the contents of this mobile application and website are protected by national and international copyright and trademark laws and are the property of MyPark. You may not change or delete any author credit, trademark, legend, proprietary or copyright notice. You must follow and observe all additional copyright notices or other restrictions contained in any parts of the website or application. All other trademarks not owned by MyPark or its subsidiaries that appear on this site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by MyPark or its subsidiaries.

We own and shall retain all rights and interest in the intellectual property rights in the content, services, and our proprietary information, which includes without limitation, all software, source and object code, specifications, metrics, customizations, designs, processes, techniques, concepts, improvements, discoveries and inventions, including, without limitation, any modifications, improvements or derivative works thereof and all works of authorship or inventions created, invented, reduced to practice or delivered by us or any third party either solely or jointly with others, arising from these Terms and Conditions, including all copies and portions thereto, whether made by or under the direction of us or you.

20. Other Terms

The Account and your obligations under this agreement may not be assigned except to an authorized user who is an approved enrollee in the program. We may transfer our rights under this agreement at any time.?? Use of the Account is subject to all applicable rules and customs of any payment processor, clearinghouse or other association involved in transactions. We do not give up our rights by delaying or failing to exercise them at anytime. If any term of this agreement is found by a court to be illegal or not enforceable, all other terms will still be in effect. If we take legal action against you because of default in the terms of this agreement, you must pay reasonable attorney’s fees and other costs of the proceedings. Your responsibility for fees and costs shall in no event exceed the maximum allowed by law.

21. Parking Regulations

All notices and signs or directions made by relevant government authorities, traffic attendants or authorized persons (e.g., the suspension of a parking space) shall take precedence over any information that you receive from MyPark. The parking garage or parking lot owner’s parking regulations apply to you and your use of the Services does not exempt you from following their rules. Parking rates can be changed by the parking garage or parking lot owner at any time. Increases or modifications to parking fees may be beyond MyPark’s control. We pass the fees through to you and we are not responsible for any fee increases.

22. Parking Responsibilities

You are responsible for ensuring that you have properly activated the Services for the relevant parking zone before you leave your vehicle unattended. You are responsible for any fine, ticket or penalty charge issued between the time of parking the vehicle and the notification via mobile telephone or internet that the vehicle is validly parked.

MyPark is not responsible for any fines, parking tickets, penalty notices and the enforcement of vehicle parking related offenses you incur or receive. You are solely responsible for resolving with the relevant authorities any issues that you may have regarding the issuance of fines, parking tickets, penalty notices or your vehicle being impounded. If you authorize MyPark to contact the relevant authorities on your behalf regarding the issuance of fines, parking tickets or penalty notices, you acknowledge and agree that in such cases, MyPark may provide all or a portion of your personal details to the relevant authorities. In addition, in the event that you fail to pay any amounts owing for the Services (whether due to a declined credit card or other circumstances), then MyPark, upon the reasonable request of the relevant authorities, may provide all or a portion of your personal details to such authorities, which you acknowledge and agree that they may use solely for purposes of collecting or attempting to collect any unpaid amounts owed by you. Notwithstanding the foregoing, in no event shall MyPark provide any of your credit card data to the relevant authorities in connection with such collection matters.

23. Service Description

We attempt to be as accurate as possible when describing our Services, however, we do not warrant that the service descriptions are complete, reliable, current or error-free. If a service offered on the Site or the Application is not as described, your sole remedy is to cancel the Services.

24. SMS MESSAGES, MOBILE APPLICATION PUSH AND EMAIL NOTIFICATIONS

MyPark may send reminders, alerts (further referred to as ‘notifications’), or critical service-related notifications via SMS text message, (“Mobile application”) push or email to its users, and you acknowledge and consent to the receipt of such messages. MyPark may use its carrier of choice for SMS message delivery. You certify that you are the account holder of the mobile phone number provided to MyPark or that you have the account holder’s express permission to use the specified phone to receive text messages about your account from MyPark. With each parking session, you may receive standard SMS messages, push or emails relating to your parking session or MyPark service communications. Message and data rates may apply.  You acknowledge and agree that the reception of SMS messages, push and emails is not 100% guaranteed and that you are responsible for the timely activation or deactivation of a parking transaction. You further acknowledge and agree that the reception of SMS messages, push and emails is dependent on the operation of your mobile phone provider and/or internet service provider and the service of the mobile phone company and/or internet service provider with which you have an account or prepaid card. MyPark shall have no responsibility or liability for the damages and costs incurred by your not receiving an SMS message, push or email on time or by the insufficient operation of your mobile network, mobile phone company and/or internet service provider. You may opt out of receiving SMS text messages, push or email notifications at any time. Opting out of SMS, email or push notifications can be completed my sending an email to info@myparksystems.com. Opting out will not bar you from receiving messages related to your Account maintenance and billing. (In the case of Push notifications the user must choose to stop receiving within their mobile phone.)

25. INDEMNIFICATION

You agree to indemnify, defend and hold us, our subsidiaries and affiliates and each of our respective officers, directors, agents, employees, independent contractors and suppliers, harmless from any claim, demand, action, cost and expense, including reasonable attorneys’ fees, due to or arising out of the following events: (i) your giving us any information which is inaccurate; (ii) your breach of any warranty, representation or other obligation set forth in these Terms and Conditions; (iii) your negligence or willful misconduct; (iv) your violation of any law, regulation or right of any third party; (v) any dispute or action between you and any third party, including parties selling or advertising goods or Services on this website; and (vi) your use of this website or the Application or the products or Services of MyPark or any third party.

26. MISCELLANEOUS

If any provision of these Terms and Conditions are found unlawful, void or for any reason unenforceable, then that provision will be considered severable from the remaining Terms and Conditions, and will not affect the validity and enforceability of the remaining provisions. These Terms and Conditions are the entire agreement between you and us relating to the subject matter hereof. These Terms and Conditions may be modified only by our posting of changes to these Terms and Conditions, or by a writing signed by both parties. 27. ACCESSING AND DOWNLOADING THE APPLICATION FROM ITUNES

The following applies to any App Store Sourced Application:

You acknowledge and agree that (i) this Agreement is concluded between you and Company only, and not Apple, and (ii) MyPark (“Company”), not Apple, is solely responsible for the App Store Sourced Application and content thereof. Your use of the App Store Sourced Application must comply with the App Store Terms of Service. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App Store Sourced Application.

In the event of any failure of the App Store Sourced Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App Store Sourced Application to you and to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App Store Sourced Application. As between Company and Apple, any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Company.

You and Company acknowledge that, as between Company and Apple, Apple is not responsible for addressing any claims you have or any claims of any third party relating to the App Store Sourced Application or your possession and use of the App Store Sourced Application, including, but not limited to: (i) product liability claims; (ii) any claim that the App Store Sourced Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.

You and Company acknowledge that, in the event of any third party claim that the App Store Sourced Application or your possession and use of that App Store Sourced Application infringes that third party’s intellectual property rights, as between Company and Apple, Company, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim to the extent required by this Agreement.

You and Company acknowledge and agree that Apple, and Apple’s subsidiaries, are third party beneficiaries of this Agreement as related to your license of the App Store Sourced Application, and that, upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement as related to your license of the App Store Sourced Application against you as a third party beneficiary thereof.  Without limiting any other terms of this Agreement, you must comply with all applicable third party terms of agreement when using the App Store Sourced Application.

28. INTERNET DELAYS

29. USE OF MYPARK® PARKING DEVICE

Please watch your step in the MyPark® Zone, MyPark® Devices are located on the ground. Do not trip.
DO NOT ENTER PARKING SPOT UNTIL ARM OF PARKING DEVICE LOWERS COMPLETELY.
Upon exiting parking spot ARM automatically raises. DO NOT re-enter spot or risk damage to your vehicle.
ARM MAY CAUSE SERIOUS BODILY INJURY.
Arm may move at any time without any prior warning.
Do not allow children or pets to play with or around MyPark® Device.
Do not stand on or place any body part on MyPark® Device.
Be sure the arm is fully raised before driving away.
